"I worked on a case in which a guitarist was suing his former band to receive song royalties," Krivis says. "The lead singer was in turn countersuing him with an injunction to remove the guitarist's name from any historical reference to the band. We weren't able to settle the disagreement until the guitarist shared his true concern. He explained to me that as a struggling musician he needed to be able to say he was a part of the successful band so that more people would want to work with him. Once I knew his true motivation, I could move the negotiation forward. We got the singer on the phone so that the guitarist could explain his situation. Once the two had a chance to talk it out, we were able to come to a resolution that they could both live with. The guitarist would receive a royalties payment and would still be able to say he had been a part of the band. We also managed to salvage the relationship between the lead singer and the guitarist."
